Online Betting in Australia – Legal or Not?

Betting has always been a part of the Australian way of life. Often you will hear the term ‘I Bet’ when speaking with an Australian. Even so there have been many questions with regards to the promotion of online betting in Australia. The Australian government passed laws several years ago which banned the promotion of online gaming such as poker, slot machines,casinos and online games of chance. They did not ban the promotion of sports betting. The reason for these laws being implemented was to protect society from the dangers of obsessive gambling. Many people think it was because of the large amounts of money being funnelled out of Australia to foreign gaming sites on wich no tax could be applied.

There were moves to also outlaw the promotion of online sports betting but the sportsbook companies licenced to provide such services threatened to take legal action if these laws were implemented as they had paid large sums of money for their licences.

On the search engine and online advertising side search engines such as Google will not allow the advertising of any Australian gambling sites though their PPC advertising platform, AdWords. This seems to only apply to Australian advertising as I have noticed several times the promotion of UK and US sites using their PPC system.

Affiliate Marketers are making considerable income promoting online sports betting sites such as Sportingbet, BetFair, Income Access (Ladbrokes, Sports Alive and Canbet) and  Centrebet Affiliate Program. You may need a web site of your own to join some of these affiliate programs and some you may be able to promote through banner exchanges and other advertising methods.

Is it immoral to promote sports betting? This question has been asked over and over again. Personally I think that whether I were to promote sports betting or not, someone else would. One example: while watching the NRL Rugby League games there is a constant reference to the latest betting odds by commentators and screenshots of the latest odds from specific sports betting agencies.

    I have also had issues with people who think it is immoral to promote any type of online gambling. The banner exchange does not allow this but I do not have a problem with it personally.

    When Australia was first colonised by people from the West, those people brought with them not only a broad social acceptance of gambling – many of them were from what is now called the UK – but an expectation of legalised gambling.

    In short order there arose a thriving industry in horse racing (and in betting on their outcomes), and Australia soon developed legislation governing a great number of gambling forms, including most of the classic table games of European casinos, and gradually incorporating more local forms of entertainment.

    Online gambling remains in an odd legal position in Australia: on the one hand it is technically not illegal for a person to play poker or casino games online, but on the other hand it is specifically illegal for any enterprise to offer online gambling services to Australians, provided they are respectful of Australian law. The reality is that the vast majority of online casinos and poker rooms happily accept Australian players, apparently unconcerned by threat of prosecution in Australia.
